animation_style=&#8221;slide&#8221; open=&#8221;on&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<p><b>Residential Estate<\/b><b>\u00a0<\/b><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> <\/span><b>One dwellinghouse: <\/b><span style=\"font-weight: 400;\">There shall not be erected or built or caused or permitted to be\u00a0 erected or built on any lot forming part of the Development or any part thereof any\u00a0 buildings or erections other than one dwellinghouse\/building of freehold construction for\u00a0 residential purposes (not apartments, townhouses or condominiums) provided that any\u00a0 additions to and\/or extensions and\/or replacement of any building or erection at any time\u00a0 thereon shall not be carried out without the requisite Permission of the Chief Town\u00a0 Planner.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>No business: <\/b><span style=\"font-weight: 400;\">The Purchaser(s) must not at any time to use or cause or permit to be used\u00a0 any lot forming part of the Development or any part thereof or any building or erection\u00a0 thereon for the carrying on of any trade profession school church chapel or business\u00a0 whatsoever (but the rental of the buildings or erections on any lot forming part of the\u00a0 Development for residential purposes shall not be deemed to be the carrying on of any\u00a0 trade or business).\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Construction<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"3\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>One storey: <\/b><span style=\"font-weight: 400;\">No building or erection on lots 1-10 shall exceed one (1) storey of twenty\u00a0 (20) feet in height from the highest point of the lot on which it is built and having an\u00a0 internal floor area of no less than 112 square metres (1200 square feet). No one storey\u00a0 building shall be constructed for an original cost (exclusive of the cost of the land on which\u00a0 it stands) of less than two hundred thousand dollars currency of Barbados\u00a0 (BDS$250,000.00).\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Two storey<\/b><span style=\"font-weight: 400;\">: No building or erection on lots 11-67 shall exceed two (2) storeys of twenty eight (28) feet in height including basement from the highest point of the lot on which it\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">is built and having an internal square of no less than 185.81 square metres (2,000 square\u00a0 feet). No two storey building shall be constructed for an original cost (exclusive of the cost\u00a0 of the land on which it stands) of less than Three hundred and fifty thousand dollars\u00a0 currency of Barbados (BDS$350,000.00).\u00a0<\/span><\/p>\n<ol start=\"5\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Certified plans: <\/b><span style=\"font-weight: 400;\">All buildings and erections on any lot forming part of the Development\u00a0 shall not be constructed or made other than in accordance with detailed plans and\u00a0 specifications with elevations prepared and certified by a qualified architect or designer all\u00a0 being approved by the Vendor and subject to the requisite Permission of the Chief Town\u00a0 Planner before any construction is commenced.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Material: <\/b><span style=\"font-weight: 400;\">No building shall be constructed with materials other than coral stone or\u00a0 reinforced concrete blocks or hollow clays blocks or any similar building material nor with\u00a0 a roof clad other than with clay tiles or wooden or asphalt shingles or enviro shake or\u00a0 profile sheeting or other similar material but not with corrugated galvanized metal sheets.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Duration of Construction: <\/b><span style=\"font-weight: 400;\">Any building works in connection with the construction of a\u00a0 house or houses or any erections thereon on any lot forming part of the Development\u00a0 once commenced shall be completed no later than fourteen (14) months from the date\u00a0 such building works commenced.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Finishes: <\/b><span style=\"font-weight: 400;\">All exteriors are to be finished within 60 days after practical completion of\u00a0 construction or occupation (whichever is earlier) and all exteriors are to be finished to a\u00a0 high standard with paint, coral render, towel plastic or similar material all of neutral\u00a0 colours.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Buildings<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"9\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Good repair: <\/b><span style=\"font-weight: 400;\">Not to allow the building on the to fall into a state of disrepair and to ensure\u00a0 that the same is maintained in good and substantial repair and condition.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Detached structures\/erections: <\/b><span style=\"font-weight: 400;\">No detached garages or carports shall be developed,\u00a0 constructed or installed on any lot forming part of the Development unless the\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">architectural design of such structure is consistent with the residential unit and the\u00a0 structure is approved by the Vendor subject to the requisite Permission of the Chief Town\u00a0 Planner. Except as may be permitted by the Vendor no tent, utility shed shack, trailer,\u00a0 outbuilding or other unattached structure shall be placed on the lot unless such structure\u00a0 will be used for special short-term occasions.\u00a0<\/span><\/p>\n<ol start=\"11\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Fences: <\/b><span style=\"font-weight: 400;\">Not to erect or construct or caused to be erected or constructed on any lot\u00a0 forming part of the Development a fence or boundary enclosure made of or incorporating\u00a0 corrugated sheeting such as galvanize, aluminium, zinc or other similar material and such\u00a0 fence shall be at a height in accordance with the current Town Planning Regulations but\u00a0 not exceeding six (6) feet.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Gardens:<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"12\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Maintenance: <\/b><span style=\"font-weight: 400;\">Not to allow the gardens of any lot forming part of the Development to\u00a0 become overgrown or untidy and to keep the grass thereon properly mown at all times\u00a0 whether or not a dwellinghouse is constructed thereon.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Garden waste, etc.: <\/b><span style=\"font-weight: 400;\">No lumber, grass, shrubs, trees, clippings, plant waste, metals, bulk\u00a0 material, scraps, rubbish, trash, garbage, or other waste material shall be permitted to be\u00a0 kept, stored or allowed to accumulate on any portion of the areas of any lot forming part\u00a0 of the Development except within an enclosed structure appropriately screened from view\u00a0 erected for that purpose.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>V<\/b><b>erge: <\/b><span style=\"font-weight: 400;\">There shall not be planted or permitted to be grown any hedges, shrubs, trees or\u00a0 plants other than grass on the verge forming any part of any lot and such grass shall be\u00a0 kept properly mown.\u00a0\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Carriageway<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"15\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Good repair: <\/b><span style=\"font-weight: 400;\">The area of any road reserve (including the verges and carriageway thereof)\u00a0 which is included in any lot forming part of the Development shall not be permitted or\u00a0 allowed to deteriorate or fall into a state of disrepair.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>No building material: <\/b><span style=\"font-weight: 400;\">No mixing of concrete or other construction works shall be\u00a0 permitted on any road reserve (including the verge and carriageway thereof) in the\u00a0 Development.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>V<\/b><b>ehicles<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"17\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>V<\/b><b>ehicle storage and repairs: <\/b><span style=\"font-weight: 400;\">Not at any time to use or permit any lot forming part of\u00a0 the Development for the parking or storing of vehicles with the exception of private\u00a0 automobiles and passenger type vans, jeeps and pick-ups having a capacity of no more\u00a0 than two tons of the owner or occupier of the lot provided that any such vehicle not in a roadworthy or useable condition shall not be so parked or stored on the lot unless it is in\u00a0 a fully enclosed garage and neither shall any vehicle be restored or repaired on any lot or\u00a0 roads forming part of the Development.\u00a0<\/span><\/li>\n<li><b> <\/b><b>No public service or commercial vehicles: <\/b><span style=\"font-weight: 400;\">No buses, trucks, minibuses, route, taxis\u00a0 trailers or any public service vehicles or any commercial vehicles shall be parked or stored\u00a0 in or upon any lot forming part of the Development or the Open Area save that those\u00a0 vehicles are permitted to make deliveries.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>A<\/b><b>menities<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"19\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Pets: <\/b><span style=\"font-weight: 400;\">Not to keep raise or breed upon any lot forming part of the Development any animals, wildlife, livestock, reptiles or poultry of any kind shall be raised, bred or kept on\u00a0 any portion of the lots save and except dogs cats and common household pets and\u00a0 provided always that such lots are fully enclosed by walls or fences.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Burning:<\/b> <span style=\"font-weight: 400;\">No outside burning of wood, leaves, trash, garbage or household refuse shall be\u00a0 permitted on any lot forming part of the Development.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Nuisance: <\/b><span style=\"font-weight: 400;\">No hazardous substances, materials, gasoline or other fuel shall be kept or\u00a0 permitted to be kept on any lot forming part of the Development neither shall any lot be\u00a0 used in whole or in part for the storage of any property or thing that will cause it to appear\u00a0 to be in an unclean or untidy condition; nor shall any substance thing or material be kept\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">upon any portion of any lot that will emit foul or obnoxious odours or that will cause any noise or other condition that will or might disturb the peace, quiet, safety, comfort, or\u00a0 serenity of the Development.\u00a0\u00a0<\/span><\/p>\n<ol start=\"22\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Laundry: <\/b><span style=\"font-weight: 400;\">No clothing or household fabrics shall be hung, dried or aired on any lot\u00a0 forming part of the Development in a manner which is visible from any roadway. 23. <\/span><b>External transmitters: <\/b><span style=\"font-weight: 400;\">No exterior antennas, aerials, mast, satellite dishes, or other\u00a0 apparatus for the receipt or transmission of television, radio, or other signals of any kind\u00a0 shall be placed, allowed, or maintained upon the exterior of any building of any lot, neither\u00a0 shall any radio station or shortwave operations of any kind be operated from the lot, unless\u00a0 the prior approval of the Vendor is first obtained.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Utility Lines: <\/b><span style=\"font-weight: 400;\">No overhead utility lines, including without limitation lines for electric,\u00a0 telephone and cable television, shall be permitted on any lot, except for temporary lines as\u00a0 required during construction.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Signs: <\/b><span style=\"font-weight: 400;\">No sign, billboard, flag, banner, or advertisement of any kind including, without\u00a0 limitation &#8220;for sale&#8221; signs and those of realtors, contractors and subcontractors, shall be\u00a0 erected on the lot without the written consent of the Vendor.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Town Planning<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"26\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Not to breach planning permissions: <\/b><span style=\"font-weight: 400;\">To duly perform and observe such of the\u00a0 conditions mentioned in and\/or attached to all relevant permissions of the Chief Town\u00a0 Planner insofar as the same are to be performed and observed by the owner or owners for\u00a0 the time being of any lot forming part of the Development and to keep the Vendor and\u00a0 its successors in title harmless and indemnified against any actions suits or other\u00a0 proceedings in respect thereof.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Subdivision<\/b><span style=\"font-weight: 400;\">: No lot shall be subdivided nor shall its boundary lines be changed except\u00a0 with the prior written approval of the Vendor subject to the requisite permission of the\u00a0 Chief Town Planner.<\/span><\/li>\n<\/ol>\n<p>[\/et_pb_toggle][et_pb_toggle title=&#8221;Residential Development Restrictive Covenants&#8221; _builder_version=&#8221;4.5.3&#8243; feet.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Gardens:<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"12\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Maintenance: <\/b><span style=\"font-weight: 400;\">Not to allow the gardens of any lot forming part of the Development to\u00a0 become overgrown or untidy and to keep the grass thereon properly mown at all times\u00a0 whether or not a dwellinghouse is constructed thereon.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Garden waste, etc.: <\/b><span style=\"font-weight: 400;\">No lumber, grass, shrubs, trees, clippings, plant waste, metals, bulk\u00a0 material, scraps, rubbish, trash, garbage, or other waste material shall be permitted to be\u00a0 kept, stored or allowed to accumulate on any portion of the areas of any lot forming part\u00a0 of the Development except within an enclosed structure appropriately screened from view\u00a0 erected for that purpose.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>V<\/b><b>erge: <\/b><span style=\"font-weight: 400;\">There shall not be planted or permitted to be grown any hedges, shrubs, trees or\u00a0 plants other than grass on the verge forming any part of any lot and such grass shall be\u00a0 kept properly mown.\u00a0\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Carriageway<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"15\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Good repair: <\/b><span style=\"font-weight: 400;\">The area of any road reserve (including the verges and carriageway thereof)\u00a0 which is included in any lot forming part of the Development shall not be permitted or\u00a0 allowed to deteriorate or fall into a state of disrepair.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>No building material: <\/b><span style=\"font-weight: 400;\">No mixing of concrete or other construction works shall be\u00a0 permitted on any road reserve (including the verge and carriageway thereof) in the\u00a0 Development.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>V<\/b><b>ehicles<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"17\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>V<\/b><b>ehicle storage and repairs: <\/b><span style=\"font-weight: 400;\">Not at any time to use or permit any lot forming part of\u00a0 the Development for the parking or storing of vehicles with the exception of private\u00a0 automobiles and passenger type vans, jeeps and pick-ups having a capacity of no more\u00a0 than two tons of the owner or occupier of the lot provided that any such vehicle not in a roadworthy or useable condition shall not be so parked or stored on the lot unless it is in\u00a0 a fully enclosed garage and neither shall any vehicle be restored or repaired on any lot or\u00a0 roads forming part of the Development.\u00a0<\/span><\/li>\n<li><b> <\/b><b>No public service or commercial vehicles: <\/b><span style=\"font-weight: 400;\">No buses, trucks, minibuses, route, taxis\u00a0 trailers or any public service vehicles or any commercial vehicles shall be parked or stored\u00a0 in or upon any lot forming part of the Development or the Open Area save that those\u00a0 vehicles are permitted to make deliveries.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>A<\/b><b>menities<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"19\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Pets: <\/b><span style=\"font-weight: 400;\">Not to keep raise or breed upon any lot forming part of the Development any animals, wildlife, livestock, reptiles or poultry of any kind shall be raised, bred or kept on\u00a0 any portion of the lots save and except dogs cats and common household pets and\u00a0 provided always that such lots are fully enclosed by walls or fences.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Burning:<\/b> <span style=\"font-weight: 400;\">No outside burning of wood, leaves, trash, garbage or household refuse shall be\u00a0 permitted on any lot forming part of the Development.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Nuisance: <\/b><span style=\"font-weight: 400;\">No hazardous substances, materials, gasoline or other fuel shall be kept or\u00a0 permitted to be kept on any lot forming part of the Development neither shall any lot be\u00a0 used in whole or in part for the storage of any property or thing that will cause it to appear\u00a0 to be in an unclean or untidy condition; nor shall any substance thing or material be kept\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">upon any portion of any lot that will emit foul or obnoxious odours or that will cause any noise or other condition that will or might disturb the peace, quiet, safety, comfort, or\u00a0 serenity of the Development.\u00a0\u00a0<\/span><\/p>\n<ol start=\"22\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Laundry: <\/b><span style=\"font-weight: 400;\">No clothing or household fabrics shall be hung, dried or aired on any lot\u00a0 forming part of the Development in a manner which is visible from any roadway. 23. <\/span><b>External transmitters: <\/b><span style=\"font-weight: 400;\">No exterior antennas, aerials, mast, satellite dishes, or other\u00a0 apparatus for the receipt or transmission of television, radio, or other signals of any kind\u00a0 shall be placed, allowed, or maintained upon the exterior of any building of any lot, neither\u00a0 shall any radio station or shortwave operations of any kind be operated from the lot, unless\u00a0 the prior approval of the Vendor is first obtained.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Utility Lines: <\/b><span style=\"font-weight: 400;\">No overhead utility lines, including without limitation lines for electric,\u00a0 telephone and cable television, shall be permitted on any lot, except for temporary lines as\u00a0 required during construction.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Signs: <\/b><span style=\"font-weight: 400;\">No sign, billboard, flag, banner, or advertisement of any kind including, without\u00a0 limitation &#8220;for sale&#8221; signs and those of realtors, contractors and subcontractors, shall be\u00a0 erected on the lot without the written consent of the Vendor.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Town Planning<\/b><b>\u00a0<\/b><\/p>\n<ol start=\"26\">\n<li><span style=\"font-weight: 400;\"> <\/span><b>Not to breach planning permissions: <\/b><span style=\"font-weight: 400;\">To duly perform and observe such of the\u00a0 conditions mentioned in and\/or attached to all relevant permissions of the Chief Town\u00a0 Planner insofar as the same are to be performed and observed by the owner or owners for\u00a0 the time being of any lot forming part of the Development and to keep the Vendor and\u00a0 its successors in title harmless and indemnified against any actions suits or other\u00a0 proceedings in respect thereof.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> <\/span><b>Subdivision<\/b><span style=\"font-weight: 400;\">: No lot shall be subdivided nor shall its boundary lines be changed except\u00a0 with the prior written approval of the Vendor subject to the requisite permission of
